What types of rideshare accident cases do you handle in Tampa?
At MattLaw, our car accident lawyers represent anyone who is injured while a passenger of an Uber or Lyft or who is struck by one of these drivers as a pedestrian. Many of the accidents that Uber and Lyft drivers cause are the same as other car accidents. These accidents include:
- Head-on crashes
- Rear-end accidents
- Broadside accidents
- Multi-vehicle accidents
- Intersection accidents
- Single-vehicle accidents
- Accidents caused by defective car parts
Our Tampa Uber & Lyft accident lawyers also handle accidents that are unique to rideshare drivers. These accidents include collisions while an Uber or Lyft driver is looking for a ride and while there is a passenger in the car.
Why do Uber & Lyft accidents happen in Tampa?
Accidents happen in rideshare vehicles because the driver is:
- Looking at their GPS instead of the road
- Talking or using a cell phone to make reservations
- Driving while distracted by a cell phone, food, drink, or other reasons
- Driving while fatigued
- Driving while intoxicated
- Driving too fast for traffic or weather conditions
- Other reasons
Uber and Lyft drivers have a duty to be extra careful because they’re transporting humans and being paid for that transport.

How does rideshare liability and insurance work in Tampa?
At MattLaw, we understand when the insurance company for the driver pays your damage claim and when the insurance carrier for Uber and Lyft pays your claim. Which insurance company pays your claim depends on whether the rideshare driver is on-duty or off-duty.
Off-duty requirements
If your driver is driving while they’re off-duty, the liability carrier for the Uber/Lyft driver should pay your damage claim. All drivers in Florida are required to have the following liability insurance coverage:
PIP (personal injury protection) and PDL (property damage liability) insurance in the minimum amounts of $10,000 for PIP and $10,000 for PDL. “Vehicles registered as taxis must carry bodily injury liability (BIL) coverage of $125,000 per person, $250,000 per occurrence, and $50,000 for (PDL) coverage.”
On-duty requirements
The insurance obligations vary as follows:
- Period 1. While the Uber or Lyft driver’s app is on and they’re waiting for a ride, the driver’s personal rideshare insurance should cover your damages. Uber or Lyft may be responsible for an additional amount.
- Period 2. While the rideshare driver has accepted a ride and is en route to pick up the passenger, liability coverage is also shared between the driver and Uber or Lyft.
- Period 3. Uber or Lyft pays the damages to anyone injured due to the driver’s negligence – when a passenger is in the vehicle.
Generally, Uber and Lyft provide $1 million in bodily injury liability insurance while the rideshare driver is logged into the app, waiting for a request, on their way to pick up a passenger, and transporting a passenger.
Don’t worry. We know this is confusing. We understand which insurance companies are responsible and how much they should pay for your personal injury damage or wrongful death damages.
We also understand the various Florida rideshare regulations, such as who is eligible to drive an Uber or a Lyft.
